Terms of Service for AutoGangSheet (Pro)

These Terms of Service ("Terms") govern your access to and use of AutoGangSheet (the "App" or the "Service"), operated by Dijital Merkez ("we", "us", "our"). By installing the App, creating an account, or using the gang sheet builder, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

AutoGangSheet is a web-based tool that lets merchants and their customers arrange artwork on production-ready gang sheets for DTF/transfer printing, and integrates with Shopify-supported stores for order processing. The Service also offers optional integrations (such as Canva and Google Drive) that let you import artwork from your own third-party accounts.

2. Accounts and Access

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must provide accurate information when creating an account and keep it up to date.
• We may suspend or terminate accounts that violate these Terms or that are used for unlawful activity.

3. Your Content

• You retain all rights to the images, designs, and files you upload to or import into the Service ("Your Content").
• You grant us a limited, non-exclusive license to store, process, and reproduce Your Content solely as needed to provide the Service (for example, generating gang sheets and print-ready files).
• You are solely responsible for ensuring that you own or have the necessary rights and licenses to use, print, and reproduce Your Content, including artwork imported from third-party services such as Canva or Google Drive.
• You must not upload or import content that is unlawful, infringes intellectual property rights, or violates the rights of any third party. We may remove such content and suspend the related account.

4. Third-Party Services

The Service integrates with third-party platforms, including Shopify, Canva, and Google Drive. Your use of those platforms is governed by their own terms and privacy policies. Connecting a third-party account is optional and can be disconnected at any time; see our Privacy Policy for details on how these integrations handle your data. We are not responsible for the availability or behavior of third-party services.

5. Acceptable Use

You agree not to:

• use the Service for any unlawful purpose or in violation of any applicable law;
• attempt to gain unauthorized access to the Service, other users' accounts, or our systems;
• interfere with or disrupt the integrity or performance of the Service;
• resell or redistribute the Service except as expressly agreed with us in writing.

6. Fees and Billing

Certain features of the Service are provided for a fee. Applicable fees, billing cycles, and usage-based charges are presented to you in the App or agreed with us before they apply. Fees are non-refundable except where required by law or expressly stated otherwise.

7. Intellectual Property

The Service, including its software, design, and branding, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or software other than the right to use the Service as intended.

8. Availability and Changes to the Service

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features of the Service at any time. Where changes are material, we will make reasonable efforts to notify affected users in advance.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising out of these Terms or the Service shall not exceed the amounts you paid to us for the Service in the twelve (12) months preceding the claim.

11. Termination

You may stop using the Service and uninstall the App at any time. We may suspend or terminate your access to the Service if you materially breach these Terms. Upon termination, your right to use the Service ceases; provisions that by their nature should survive termination (including Sections 3, 7, 9, 10, and 12) will survive.

12. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or the Service shall be submitted to the competent courts of the Netherlands, unless mandatory consumer law provides otherwise.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the latest changes were made. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
